These terms and conditions ("agreement") govern the provision of creative courses by Atelier Amsterdam Offline ("company") chamber of Commerce number: 89050169 to individuals ("customer") who enroll in our courses. By enrolling in a course, Participants agree to be bound by the terms and conditions set forth below.
Article 1. General
- These general terms and conditions apply to all agreements between the customer and Atelier Amsterdam Offline and to all work performed by Atelier Amsterdam Offline on behalf of the customer.
- These general terms and conditions are made available to the customer before or upon the conclusion of the agreement.
- Deviations from these general terms and conditions are only valid if expressly agreed upon in writing or by email.
- If one or more provisions of these general terms and conditions are null and void or are declared invalid, the remaining provisions of these general terms and conditions will remain in full force and effect. The null and void or invalidated provisions will be replaced by Atelier Amsterdam Offline, while preserving the purpose and scope of the original provision(s) as much as possible.
- If Atelier Amsterdam Offline does not insist on strict compliance with these general terms and conditions, this does not mean that the provisions thereof do not apply or that Atelier Amsterdam Offline would lose the right to demand strict compliance with the provisions of these general terms and conditions in other cases.
- Atelier Amsterdam Offline has the right to unilaterally amend these general terms and conditions during the agreement.
- The customer who brings introducees or guests is responsible for forwarding the general terms and conditions to the participants invited by them.
Article 2. Offers and Quotes
- All offers and quotes are entirely non-binding. The period of special offers is stated in the relevant offer.
- Obvious errors or mistakes on the website and in quotes or email messages from Atelier Amsterdam Offline do not bind Atelier Amsterdam Offline.
- Quotes do not automatically apply to future orders.
Article 3. Execution of the Agreement
- Atelier Amsterdam Offline ensures, with all due diligence, that the work performed by it is carried out in accordance with the requirements of good craftsmanship and using sound materials.
- Atelier Amsterdam Offline has the right to have the agreement (partially) executed by third parties. In the event that third parties are engaged in the execution of the agreement, Atelier Amsterdam Offline will exercise due care in the selection.
Article 4. Prices, course enrollment, payment and confirmation
- Participants may enroll in a course by completing the registration process through email.
- Course enrollment is subject to availability. The course will only commence if there are six or more confirmed participants. (dubbel)
- Upon successful enrollment and confirmation of the course, Participants will receive a confirmation email with relevant details and instructions.
- The price that the customer must pay is known or agreed upon in advance.
- Atelier Amsterdam Offline has the right to adjust prices or rates from time to time. If the change affects an ongoing agreement, the customer will be notified in writing or by email four weeks prior to the effective date. If the customer does not agree to the price change, the customer has the right to terminate the agreement by means of a written or electronic statement within 2 weeks after being notified of the price change.
- All amounts and prices charged by Atelier Amsterdam Offline are inclusive of material use, unless otherwise stated. The use of tools is also included, unless otherwise specified. Unused materials, tools, and other supplies remain the property of Atelier Amsterdam Offline, unless otherwise agreed upon.
- In the case of (children's) parties or other individually agreed-upon assignments, the minimum number of participants is 8. If there are fewer participants, this will not be deducted from the total amount, unless otherwise determined by Atelier Amsterdam Offline.
- Participants are required to make full payment at the time of enrollment to secure their place in the course.
- All payments shall be made in the currency specified by the company and through the approved payment methods as indicated on our website or other approved channels.
- The Company reserves the right to change the course fee at any time, provided that Participants who have already enrolled and paid will not be affected by such changes.
Article 5. Cancellation, refunds and Cancellation Fees
- If the course does not reach the minimum required number of six participants, the company reserves the right to cancel the course. In such cases, participants will be notified immediately, and the full amount will be refunded within a reasonable period.
- Participants can request to withdraw. Cancellation requests must be submitted by email to the contact address designated by the company.
- Cancellations made at least 48 hours before the start date of the course are eligible for a refund, minus any administration fees determined by the company.
- Cancellations made less than 48 hours before the start of the course are not eligible for a refund.
Article 6. Accessibility
Currently, the location used by Atelier Amsterdam Offline is not accessible for wheelchair users.
Article 7. Liability
- Atelier Amsterdam Offline cannot be held liable for any damage that is a direct or indirect consequence of: a. an event that is, in fact, beyond its control and cannot be attributed to its actions or omissions; b. any act or negligence of the customer, their subordinates, or other persons employed by or on behalf of the customer.
- Atelier Amsterdam Offline is not liable for any damages of any kind resulting from incorrect or incomplete information provided by the customer.
- Atelier Amsterdam Offline is not liable for mutilation or loss of data resulting from the transmission of data using telecommunication facilities.
- Atelier Amsterdam Offline is not liable for theft of, damage to, and/or disappearance of the customer's property and goods, and is not liable for accidents. Our legal liability is insured through business liability insurance. If Atelier Amsterdam Offline were to be liable, the liability of Atelier Amsterdam Offline is limited to the amount of the payment made by Atelier Amsterdam Offline's insurer.
- Atelier Amsterdam Offline disclaims any liability for damage to property caused by the customer and/or third parties. The customer is assumed to have obtained liability insurance (for individuals) throughout the entire assignment, so that any damage to the property of Atelier Amsterdam Offline and third parties engaged by Atelier Amsterdam Offline caused by the customer is reimbursed to Atelier Amsterdam Offline. The customer is liable for the damage caused by them during the activity. Atelier Amsterdam Offline is never liable for indirect damage, including consequential damage, loss of profit, missed savings, and damage due to business interruption. Any legal claims by the customer must be filed within 1 year if the customer is dissatisfied with the work or actions of Atelier Amsterdam Offline. If the customer fails to act within the specified time, the claim will expire.
Article 8. Force Majeure
- In the event of force majeure, Atelier Amsterdam Offline is not obligated to compensate for any damage incurred by the customer, except to the extent that Atelier Amsterdam Offline has derived a benefit from the force majeure situation that it would not have had with proper performance.
- Force majeure includes, among other things: fire, water damage, lightning, power and internet outages, riots, weather conditions, theft, traffic disruptions, and illness of the natural person executing the agreement on behalf of Atelier Amsterdam Offline.
Article 9. safety
- Participants are expected to conduct themselves in a respectful and professional manner throughout the course.
- Participants shall comply with all instructions, guidelines, and safety regulations provided by the Company and its instructors.
- The Company reserves the right to remove any Participant from the course if their conduct is deemed disruptive, inappropriate, or unsafe. In such cases, no refund shall be provided.
- If necessary, Atelier Amsterdam Offline provides disposable aprons, safety goggles, etc., which should be worn. However, it remains the individual's responsibility to use them.
- The serving participant is responsible for wearing suitable clothing. Atelier Amsterdam Offline is not liable for any damage to clothing or other property.
Article 10. Audio and/or Visual Material
- Visual material obtained during the workshops may be used for our social media and/or commercial purposes unless the customer has explicitly stated in writing that this is not desirable.
- Atelier Amsterdam Offline is not liable for visual materials obtained by the participants or how the participants use these visual materials.
Article 11. Changes
- Atelier Amsterdam Offline has the right to make necessary program changes and/or cancel the activity in case of insufficient interest. Examples include engaging other teachers/facilitators or changing the location, especially if this is necessary according to (legal) regulations.
Article 12. Course Content and Schedule
- The Company will make reasonable efforts to provide accurate and up-to-date information regarding the course content, schedule, and any associated materials.
- The Company reserves the right to modify the course content, schedule, or associated materials at any time, provided that any such changes will be communicated to Participants as soon as reasonably possible.
Article 13. Complaints
- Although Atelier Amsterdam Offline makes every effort to prevent this, it is possible for a customer to have a complaint. The customer can contact Atelier Amsterdam Offline to submit a complaint. Complaints regarding the execution of the agreement must be submitted to Atelier Amsterdam Offline in a timely and motivated manner. Atelier Amsterdam Offline will handle the complaint in accordance with its internal complaints procedure.
- The acceptance of a complaint does not imply that Atelier Amsterdam Offline acknowledges that the performed work is defective.
Article 14. Applicable Governing Law and Jurisdiction
- Dutch law applies to every agreement between Atelier Amsterdam Offline and the customer.
- All disputes arising from agreements between the customer and Atelier Amsterdam Offline will be submitted to the competent court in the district where Atelier Amsterdam Offline is located. If Atelier Amsterdam Offline invokes this provision, the customer, being a consumer, has the option to choose the legally competent court within 1 month.
Article 15. Intellectual Property Rights
- All course materials, including but not limited to instructional materials, handouts, and other written or digital content, are the intellectual property of the Company and are protected by applicable copyright and intellectual property laws.
- Participants shall not reproduce, distribute, or share any course materials without the express written consent of the Company.
Article 16. Entire Agreement
- This agreement constitutes the entire agreement between Atelier Amsterdam Offline and the participants and supersedes all previous agreements, both written and oral, regarding the subject matter of this agreement.
- By enrolling in a course provided by Atelier Amsterdam Offline, participants acknowledge that they have read, understood, and agreed to abide by these terms and conditions.
